Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • The works, supplies or services can be provided only by a particular economic operator for the following reason
    • absence of competition for technical reasons
Explanation
The Intellectual Property Right of the equipment, hardware and software rests with Sixsense (a company operating in France) therefore it is not possible to compete the maintenance requirement in line with Directive 2014/24/EU. This contract is awarded to Nuvia as the UK distributor for Sixsense. Due to technical reasons introducing a new supplier would have disproportionate cost as existing equipment would need to be replaced. This would also require plant to cease operations for a considerable length of time whilst the equipment was replaced therefore temporarily stopping the high hazard risk reduction activities performed at Sellafield Ltd.
