Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • The works, supplies or services can be provided only by a particular economic operator for the following reason
    • absence of competition for technical reasons
Explanation
Springfields Fuels Ltd have held material owned by Sellafield Ltd in drums for a significant number of years under a separate contract arrangement. The material now requires sampling and re-drumming to facilitate continued long term safe storage. It is not appropriate for the material to be transferred elsewhere for this work to be conducted.
It has been determined that in the current circumstances that
competition to deliver the required supplies is absent for technical reasons and
that, pursuant to Article 32(2)(b)(ii) of Directive 2014/24/EU and Regulation 32
(2)(b)(ii) of the Public Contracts Regulations 2015, Sellafield Ltd may award a
contract to Springfields Fuels Ltd using the negotiated procedure without prior
publication of a call for competition in the Official Journal. This conclusion has
been reached following an assessment of the work to be conducted and Sellafield Ltd considers that there is no practical alternative to procuring these services from Springfields Fuels Ltd.
