Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below

Explanation
These pump inners are to support operations in the Medium Active Solids Waste
Encapsulation Plant (MASWEP). the Site Ion Exchange Effluent Plant (SIXEP) and the Fuel Handling Plant (FHP) at Sellafield Ltd. The pump inners are direct
replacements for the existing pump inners which were originally designed and
manufactured by Hayward Tyler 35 years ago. The pump inners must be compatible with the existing pump system and plant. It has been determined that in the current circumstances
that competition to deliver the required supplies is absent for technical
reasons and that, pursuant to Article 32(2)(b)(ii) of Directive 2014/24/EU
and Regulation 32 (2)(b)(ii) of the Public Contracts Regulations 2015,
Sellafield Ltd may award a contract to Hayward Tyler using the negotiated
procedure without prior publication of a call for competition in the Official
Journal. This conclusion has been reached following an assessment of the market which determined that neither a generic version of the pump inner nor an alternative inner is available
on the market which would satisfy the interoperability requirements of the
installed pump outers. To operate the plants noted, Sellafield Ltd considers
that there is no practical alternative to procuring the pump inners replacements
from Hayward Tyler as the original manufacturer.
